Fetch Fitness Client Agreement

To make sure our classes are safe, and so that everyone knows what responsibilities they have as a participant in Fetch Fitness classes, we ask that everyone agree to this waiver before they take part in our classes. 


1. Definitions of terms used

‘Agreement’ means this ‘Fetch Fitness Client Agreement’, which contains the terms upon which you will engage in Fetch Fitness.

‘Class’ means any scheduled session or period of time spent undertaking or discussing physical activities and/or exercise and/or training with, and/or under the direction of, Fetch Fitness.

‘Emergency Contact’ means a person, who is likely to be contactable and available whilst you are attending a Class, whom your Fetch Fitness Instructor can contact in the event of an emergency.

‘Instructor’ means a representative of Fetch Fitness who will host and direct your Class.  

‘Physician’ means a doctor and/or general practitioner (‘GP’).

‘We’ or ‘Our’ means Fetch Fitness.  

2. Introduction

Welcome to Fetch Fitness!

We want you, your fellow participants and your dog to enjoy Fetch Fitness as much as possible, as safely as possible, and to ensure that our Classes run smoothly. This Agreement contains some important information and terms that you need to be aware of and agree to before participating in our Classes.  

We want you to be aware that this Agreement is an important legal document that you should read carefully and ensure that you understand it. By ticking the box at the bottom of this Agreement you will be confirming that you have done so and that you agree to all of the terms within it. Therefore, if there is anything you do not understand, please contact topdog@fetch.fitness before ticking the box and entering into this Agreement. We will be happy to answer your questions.

3. Your health & safety

By entering into this Agreement you agree that, to the very best of your knowledge, you are in good physical condition and that you have no disease, physical limitation, health concern or injury that would be aggravated by strenuous physical activity, or which make you susceptible to injury.

We recommend a consultation with your Physician prior to involvement in any exercise or physical program, including Fetch Fitness Classes. Participation is at your own risk. If you choose not to obtain a Physician’s permission and guidance prior to beginning Fetch Fitness Classes, you acknowledge that this is against Fetch Fitness’s recommendation and that you may be putting yourself at an unknown level of increased risk.

Fetch Fitness is not a competition. When participating in any Class, you agree to use your best judgment in deciding what level of intensity and effort is safe and appropriate for you, and to not exceed that. It is important not to risk injuries. You agree not to exert yourself to the point that you become incapable or unable to control and take care of your dog(s).

By entering into this Agreement you agree that, if you experience any discomfort or pain during a Class, you will stop participating immediately, inform your Instructor and take appropriate medical advice. Fetch Fitness and Fetch Fitness Instructors are not medical professionals or medically trained, and cannot offer you any medical advice.

You agree to provide Fetch Fitness with the telephone number of an Emergency Contact in the event that anything should happen during a Class.

4. Payment for Classes and cancellation policy

Payment must be made online, more than 12 hours in advance of the Class, via the website. Bookings must be cancelled more than 12 hours in advance of the Class you have booked to receive a full refund for the method used to pay (one off payment or one use of your class pass).

5. Liability

5.1 Equipment

Fetch Fitness will take reasonable steps to ensure that the equipment offered for use during Classes is maintained and fit for purpose. We cannot guarantee that equipment will not break or malfunction from time to time.

You will not have any responsibility in relation to the routine wear and tear of Our equipment.

You agree to use any equipment safely and as directed by your Instructor and to take reasonable care not to damage it whilst using it.

If you intentionally or recklessly damage or render any of Our equipment unusable, or allow your dog to damage or render it unusable, you agree to meet the cost of repair or, if necessary, replacement.


5.2 Injuries and death

You will be participating in Classes involving physical exercise and activities under the direction of Fetch Fitness. Fetch Fitness Classes combine different types of exercise, depending on the class being booked, and may contain, but may not be limited to, cardio and weight/resistance training that will be physically demanding. Classes might be difficult and strenuous. There are inherent dangers and varying degrees of risk with any exercise, from minor sprains and pulled muscles to death. Again, we strongly recommend that you talk to your Physician before participating.

You agree to use your own judgment as to whether you are able to safely participate in Fetch Fitness Classes and the extent to which you push yourself physically. Your Instructor will encourage you to push yourself, but your limits are subjective and a matter for your own management and judgement.

In consideration of Fetch Fitness’s instructing, assisting, and training you in Classes, by entering into this Agreement you release, discharge from any liability and hold harmless Fetch Fitness and their respective agents, heirs, assigns, contractors and employees from any and all claims, demands, damages, rights or causes of action, present and future, arising out of or connected with participation in any Fetch Fitness Class. This includes death or injuries sustained during Classes including, without limitation, to those which may occur as a result of:

(a) your use of the equipment provided in Our Classes, and any facilities or premises used;
(b) pre-existing medical conditions and problems;
(c) inadequate instruction or supervision;
(d) the conduct or behaviour of other participants and/or their dogs;
(e) surpassing your own safe limits against our advice;
(f) dropping equipment or equipment breakage or malfunction; or
(g) any slipping, tripping and/or falling over.

5.3 Personal Belongings

Fetch Fitness recommends that you do not bring personal belongings or valuables to Classes. You understand that bringing personal belongings to Fetch Fitness Classes is done entirely at your own risk. Fetch Fitness Instructors will not take custody of any personal belongings or valuables during Classes and will have no liability for loss, theft, or damage in respect thereof.

5.4 Dogs

You agree to be solely responsible for the conduct and wellbeing of your dog(s) at all times. Fetch Fitness shall have no responsibility or liability in respect of your dog(s) or loss arising from your dog’s conduct or your management and care of your dog(s).

You agree to indemnify Fetch Fitness in respect of any loss, damages, costs, claims or charges arising from or connected to your dog’s conduct.

Dog breeds specified in the Dangerous Dogs Act 1991 are banned from all Fetch Fitness Classes and activities and by entering this Agreement you are confirming that your dog is not a breed specified in the Dangerous Dogs Act 1991.

You also confirm that your dog(s) does not have an aggressive temperament and that an exercise Class with other dogs, in close proximity, is suitable for them. Dogs are required to be off the lead during Fetch Fitness Classes and by entering into this Agreement, you confirm that your dog(s) is suitably trained for this to take place safely. 

You accept financial responsibility for any injury that you or your dog(s) cause either to you or to any other participants. You further agree to indemnify and hold harmless Fetch Fitness, their employees and volunteers from liability for the injury or death of any person(s) and damage to property that may result from negligent or intentional act or omission while participating in activities offered by Fetch Fitness.

6. Results

We are confident of the health and wellbeing benefits (and fun!) which can be achieved as a result of participation in our Classes, but we cannot offer any guarantees regarding the results that you might personally achieve. Results are individual and depend on a multitude of factors, including numerous lifestyle choices, which vary from person to person. If you have specific goals, you might like to discuss these with your Instructor, and your Instructor will work with you to achieve them as far as possible and practicable.

7. Complaints and feedback

We hope you and your dog will find Fetch Fitness Classes sociable, fun and challenging in all the right ways. However, if you’re unhappy with the service, or if you have any feedback which might be useful for us to help improve our Classes, please contact topdog@fetch.fitness.

8. Entire Agreement

This Agreement contains all of the terms agreed between you and Fetch Fitness and you confirm that, when entering into this Agreement, you are not relying on any other terms, warranties, guarantees or representations, whether written, verbal or otherwise. 

9. Your statement upon entering into this agreement

I acknowledge that I have carefully read, considered and accepted the terms this Agreement and that I fully understand them.

I am agreeing to and accepting all terms within this Agreement and I understand that I am waiving legal rights.
